CLAIM DISMISSED
SEQUEL TO ACCIDENT (Per Ptv-s.i AwoeiatiOTO AUCKLAND', this day. The sequel to an accident in a wharf shed in November, 1927, when Arthur Yates, a. tally clerk, was injured through a bale of paper striking him. after it had landed from a chute, was heard in the Supremo Court before Mr. Justice Herdman. The Union Steam Ship Co., claimed £569 18s from James Che vis, a car|ner. as indemnity for compensation paid to Yates, who was employed by the plaintiff company. It was stated for the plaintiff that the bale with which Yates was was sent down the chute bv Clievis. It weighed about 5 cwt., and on landing from the upper floor of the shed knocked Yates over. Negligence by the defendant was alleged in that the buffer usually placed on tho chute to prevent the articles bouncing after landing, had not been Vised. After hearing legal argument, His Honor gave judgment for defendant with costs.
