LOST FUR COAT.

RACING CLUB SUED. The loss of a fur coat, which was left by a lady in the cloak room at Trentham raeecouse during the winter nulling of the Wellington'Racing Club !:i-t year led to a claim on the dnh by lln owner, Louisa Emily Simons, 'of 22, Oriental terrace,, which the Magistrate uphold, giving judgment for £4O .-irul costs. From this decision tho club appealed before Ilia Honor Mr Justice Uliapman at the Supreme Court- at Wellington. Mi M. Myers and Air H. F. O’Leary approved for the appellant, and Mr <!.' Toogc.od for the respondent. The grounds of the club’s appeal wi re that it was a- gratuitous bailee, and could not he held liable unless guilty of negligence. All reasonable care had been exi-V----vised. Counsel-for appellant contended that the club, by notices posted on the walls, had indicated 1 that it was not prepared to take more than, reasonable care of the proeprty deposited in the cloak room. From a point of law it wan a “gratuitous bailee,” and had carried out all the duties of such bailee. Counsel for respondent contended Hint, where a- Magistrate had found, as a- qr->s-(ion of fact, that thorc/liad been negligence,■ the Supremo Court could., not disturb such decision, unless it found i! to he “demonstratively wrong.” After hearing argument, His Honor reserved judgment.
