In Chambers on Saturday Judge Gillies, upon the application of Mr. W. Brassey, as counsel for "R. Cooper, granted rule nisi returnable to-morrow afternoon calling upon Eyre Kenny, Esq., R.M., and Mr. W. L. Rees to show cause why the writ of prohibition should not issue against any further proceeding in the case of Rees versus Cooper, and it was ordered that in the meantime all proceedings in the matter be stayed. The ground upon which the rule was obtained was that as the matter upon which the proceedings were taken by Rees arose in the Gisborne district, the Magistrate here had no jurisdiction. The same point was raised when the case was heard, but Mr. Kenny ruled that he had jurisdiction, because he was not sitting as R. M. but as Justice of the Peace, in which he had jurisdiction all over the Colony.
