(Before H. Kenrick, Esq., KM.) THE ART-UNION CASE. 1 Walter Good was charged with having established a scheme whereby certain articles were drawn for by lottery, oh March 19th, contrary to Section 17 of the "Auckland Municipal Police Act, 1866." . Mr. Good admitted the charge, and in defence stated that it had been allowed in Gisborne up to the present, and that lotteries were permitted elsewhere. Tradespeople in Napier regularly sold tickets here for Art Unions which they got up. He was not aware that he had infringed any Act, and had only received notice previous to the drawing. His Worship said there was no doubt that the establishing of a scheme ■ such as this, where articles were drawn for by lottery, was. illegal. He was aware that such lotteries were conducted here up to tlie present, and that they were held elsewhere. The penalty for such an offence was very severe, viz., £50 ; but he presumed that this was a test case, and as such he would take into consideration the statement of the defendant, and the fact that he did not receive notice until the drawing. He would therefore inflict a nominal penalty of 205., and costs 11s. CIVIL CASES. McD.ivittv. Mackay. Judgment confessed, for amount claimed. Forbe3 and Skeet v. Harris. — Claimed £14 10s. Mr. Rogan for plaintiff. Mr. Robinson, who appeared for defendant, objected for the claim for interest (10s) but admitted the balance. His client had expressed his willingness to pay £8 on Monday, and the remainder in a fortnight. Judgment was given for the amount claimed, and £1 10s 6d costs. ■ • ■ . .. . ; D. Page v. W. McVay.— Claim £21 9s, for lodging and refreshments. Mr. W. Brassey for plaintiff. The debt was proved, and judgment given for the amount claimed, with costs £3 17.
