ITINERANT TRADERS' FEE.

AN EKETAHUNA BY-LAW. Argument as to the validity ot an Eketahuna Borough by-law regarding itinerant traders was heard in the Pahiatua Court yesterday in the case Alexander Douglas Johnston (Mr P. Page) v. Eketahuna Borough Council (Mr Gooding), the claim being for £5, the amount of an itinerant trader’s fee paid by defendant to the Borough. Mr Page claimed that the by-law was ultra vires and void. The fee was paid after objection and plaintiff traded for only one or two days in the town. Mr Gooding’s defence was that payment was voluntary. Both counsel referred the Court to various law reports of cases bearing on this point and the Magistrate reserved his decision.
