CIVIL SITTINGS

Mr A. Crooke, S.M., presided over a sitting of the Magistrate’s Court to-day.

In each of the following undefended cases judgment by default was given for plaintiff, with costs: —C. Hodder v. F. Shadbolt, jun., balance of claim 12s, costs 2s; Clark and Son v. Walter Grantham, £l2 7s 6d, costs £1 Is, solicitor’s fee 15s 6d : Clark and Son v. O. Olsen, £3 Is 2d, costs 11s, solicitor’s fee ss: Clark and Son v. Te Ao Tataurangi, £5 19s, costs 14s, solicitor’s fee 15s 6d: Robert Bee v. E. G. Thompson, £4 ss, costs os, solicitor’s fee ss. SEIZURE OF A COACH.

Alfred E. Pond was charged on the information of J. Tanner that on Vlctober 17, at Pahiatua, he did attempt to rescue a coach seized under warrant issued at Pahiatua. J. Osbume-Lilly appeared for defendant, who did not appear, but entered a plea of guilty. Constable Tanner detailed the circumstances of the case stating that the Makuri mail coach had been seized by the bailiff in the case of T. Cotter v. A. M. Holmwood. The coach was padlocked, but the chain had been cut and the coach taken out of the stables into the street.

Mr Lilly, in mitigation of what te termed merely a technical breach, pleaded that no attempt had been made to take the coach away. Pond was acting for the mortgagee, and what he had done was in order to establish an absolute right to the coach. Defendant was convicted and fined 10s, and costs 7s.
