NEGLIGENT DRIVER

DEATH AND INJURY CAUSED REMANDED FOR SENTENCE (P.A.) PALMERSTON N.. Oct. 15. Found guilty of negligently driving a car and thereby causing the death of Emily Elizabeth Powell and also causing actual- bddily injury to Margaret Remnant on the Foxton-Sanson highway, Mervyn Henry Davies. farmer, of Te Aroha, came before Mr Justice Smith in the Supreme Court to-day for sentence. It was disclosed by the judge that the accused had on three occasions been convicted of being in a state of intoxication while in charge of a car. His Honor asked if these offences should be disregarded in view of the fact that the prisoner had two " pony shandies " a short time before the accident. On submissions being raised by the defending counsel (Mr Ongley) the prisoner was remanded till to-morrow for sentence.
