Tuesday, October 14 (Before Mr H. J. Dixon. S.M.) Undefended Cases Judgment by default was given for the plaintiffs in the following cases:— Otago Drivers’ Union v. John Peter Arthur, claim 19s 6d, for arrears of contributions. with costs (9s); F. G. and E. A. Duncan v. Andrew Petersen McFarlane (Weheka). claim £l2. for rent due. with costs (£2 16s). Claim and Counter-claim Courtney Clarke Pledger (Mr 0. G. Stevens) proceeded against Roderick Ward (Mount Cargill), claiming £3 10s for two cords of wood delivered to the defendant in July of last year. The defendant, who was represented bv Mr G. T. Baylee, entered a counterclaim for £1 7s. the amount alleged to be owing for cartage carried opt for the plaintiff—After hearing evidence, the magistrate gave judgment for the plaintiff on the claim for £2 10s, and costs (£1 18s). On the counter-claim. Mr Stevens advanced the defence that the defendant did not possess a carrier’s licence and could not, therefore, substantiate his claim for cartage fees. The matter was adjourned until tomorrow to allow this point to be considered. ' A Motor Collision As the result of a collision between a motor car and a motor van which occurred at the intersection of Fingall street and Bay View road in May last, Francis Columb proceeded against Robert McCormick on a claim for damages amounting to £3s.—Mr J. P. Ward appeared for the plaintiff, and Mr J. C. Robertson for the defendant. —The defendant. Mr Ward explained, had admitted negligence and had paid the sum of £2l into court, but the plaintiff maintained that this sum did not cover depreciation and the cost of hiring a substitute vehicle. —Evidence was taken as to the repairs effected, and the hearing was adjourned until tomorrow.
