WORKERS’ COMPENSATION ACT

CLAIM BY A MINER SEQUEL TO CAGE ACCIDENT. (Peb United Press Association.) AUCKLAND, March 22. In a judgment issued to-day Mr Justice Ostler held that by section 67 of the Workers’ Compensation Act the right of John Gordon, a Waihi miner, to damages against the Waihi Gold Mining Company is limited to £IOOO. Gordon was one of the victims of the Waihi cage accident last July, and the Warden’s Court assessed his damages at £ISOO. It was contended on behalf of the defendant company, said his Honor, that the plaintiff’s right to damages was limited to £IOOO by virtue of section 67 of the Act. On behalf of the plaintiff it was contended that there was no such limit. The question for the opinion of the court was whether the defendant company’s contention was sound in law. As the defendant company had been successful In the argument his Honor awarded it £l2 12s costs, to be deducted from the amount of damages.
