Regulations ;published in the, Gazette to-night.control the supply: of cream to. dairy ifactories by restricting the transfer of'supply from one factory to another during the same season.".. The restriction applies in the North Island from August 1 in any year until May 31 in the next succeeding year, and, in v the South island from November. 1 to August 31.-.'. " • ■' .' • . -• '•• '.•' •■ ' -"• A similar regulation, issued.last year was declared ultra vires and void by the Court i of Appeal: « The nevr regulation has been made possible under the legislation passed by the last session.of Parliament. As it does not apply in June or July in the North Island nor during September or October in the South Island the supplier will have this; period in each year to make a selection of the, company which he intends to supply. Like'the old regulation the new regulation does not apply: (1) Where, during the period of restriction, the supplier obtains the consent of the dairy company concerned; (2J where a company ceases to carry on the business of purchasing milk or cream or refuses to: continue, the purchasing of milk or cream from that dairy; (3) where milk or cream is being supplied to two separate dairy' companies in stated quantities Jor propor-tions,-but only so far as those companies are concerned.
