NOMINAL DAMAGES.

ISSUE OF SEARCH WARRANT. PHOTOGRAPHER SUES FILM PRODUCER. (Feb United Pbess Association.) HAMILTON, December 2. Judgment for the plaintiff was entered in an action for £SOO damages brought in the Hamilton Supreme Court to-day before Mr Justice Herdman by Edwin Coubray, a kinema camera man, against Alexander Marky, film producer and managing director of Marky Films, Ltd., New Zealand, for malicious persecution. The action arose out of Marky issuing a search warrant against the plaintiff and submitting his person and luggage to search, Marky having entertained suspicions that Coubray was posting away some copies of film, the property of Marky Films.

His Honor held that the plaintiff had proved his ease, but said that damages in such a case could only be nominal, as the plaintiff to some extent had the whole thing. The plaintiff was awarded £lO, with 20gns costs and disbursements.
