The defence argued that anyone attending a golf course necessarily took risks. If Hobbs hit a ball into the pavilion and struck a spectator the latter had no cause of action, as he should have got out of the way.

Mr Justice Swift, in summing up, emphasised the fact that there were risks in all games, but if accidents occurred one could not complain to the courts and law. The jury decided that Miss Oldham was negligent, and that Miss CTeghorn was not negligent.—A. and N.Z. Cable.
