CLAIM FOR DAMAGES
INJURED ON GOLF COURSE. RISKS OF A SPECTATOR (Frets Association—Py Telegraph—Copyright.) LONDON, May 2. (Received May 3, at 7.40 p.m.) Tho risks taken by spectators in watch mg sports were tho subject of an action before the King’s Bench, where Miss Cleghorn, who is ignorant of golf, was awarded £l5O damages on account of a fractured cheekbone.
During a game. Miss Oldham, criticising her male opponent’s play, demonstrated how a certain drive should be made. In so doing, she struck Miss Cleghorn, who was carrying her clubs. The defence argued that anyone attending a golf course necessarily took risks. If Hobbs hit a ball into the pavilion and struck a spectator the latter had no cause of action, as he should have got out of the way.
Mr Justice Swift, in summing up, emphasised the fact that there were risks in all games, but if accidents occurred one could not complain to the courts and law. The jury decided that Miss Oldham was negligent, and that Miss CTeghorn was not negligent.—A. and N.Z. Cable.
