BENEFICIARY APPLIES (FOR RECXSSION. i 1 r " n | (Pee United Press Association.) | AUCKLAND, September 24. The unusual case of an applicant who obtained an order of the Supreme Court by which she obtained 45s a week out of a deceased estate seeking to have the order rescinded came before Mr Justice Herdman this morning. Alice Agnes Gray, a beneficiary under the will of Daniel Alexander Gray, was the applicant. Counsel stated that on the death of Alexander Gray the estate, which was worth between £7OOO and £BOOO, was left to his widow and one son, the seven daughters receiving nothing. His client applied to Mr Justice Sim for an order, and was awarded £2 6s a week out of the estate. It now transpired that his client had obtained £SOO from her mother to commence business in Wellington, and it was her wish that the £2 5s should revert back to her mother. The trustees had no objection to this course. His Honor made the required order.
