An 11 nusii;iI application was 'made fo Air Justice A\’t'ij'nll in the Practice Court in Mellxmrne recently (says (ho Age) in the ponding divorce suit, by I' rederiek Charles Holland against his wife.. Alice Alallesoli Holland, in which Frank Bonliglio i, s joined us i o respondent. The, applioation was for an order for ihe issue of a duplicate original (italion in the ease, (he original having lieen lost in peculiar circumstances. Air H. Woolf (instructed by Air J. Woolf) appeared for the petitioner in the ease, to ask for (ho order. He said corespondent was a man who had been lately in the public eye as the divorced husband of Nurse Hannah Afitehell. and it was well known that, he was an excitable man. The facts of the loss of the citation were, given in the affidavit of Loins (Rogers, private inquiry agent, of Sw.inston street, Melbourne. Rogers said, under ■ instructions from petitioner, he. went, in company with her brother, and served respondent, at Alain road. Greensborough, on the morning of April 24. On the same afternoon, also in company with petitioner’s brother, he went (o Bonllglio's place, “The Corso.” Parkdale. He was about to exhibit to Bonfiglio the original citation when Bnntiglio immediately and without warning seized the. citation and threatened fo. shout deponent, Bonfiglio cursed and used had language, and, carrying the document with him, he ran into the house. Then he (dammed (he door in tie|)oneiii's face, saying he would get. his revolver and ‘'settle” him. Deponent was unable to get the document hack. Counsel thought hi s client, in the circumstances, would not be able to recover the original document. Air Justice Weigall : Who was served first —the respondent? Mr Woolf: Yes. Air Justice Weigall: She was more ladylike and handed (ho cw.document k. lint apparently co-respondent was not I am satisfied authority permits the court to reissue the citation, and L will grant tint application.
