ALLEGED BREACHES OF COVENANT.
NEW TRIAL ORDERED. v (Peb United Press Association.) WELLINGTON. May 3. ■ h The . Chief Justice to-day ordered a new Ai m/-the case of Gallagher v. Bicknell, i claim for £6OO special damages based on llegec!’ breaches of covenant to repair buildi <(ngfi, etc., on a leased farm. The jury awarded Bfoo, and the defendant applied for a new trial -on’' the ground that the damages awarded were excessive; also that lire members of the jury were guilty of misconduct ; in discussing the case with a witness for the i , plaintiff at the luncheon adjournment dur- ‘ ing the progress of the case. The witness, d; it w# alleged, informed the jurors that, the defendant • made £20,000 out of the lease - in question. The Chief Justice said that the information was not actually material to the case, but was of such a nature that it might ' have • affected the jurymen’s findings.
