An unusual cose was heard in the Supreme Court at Palmerston North last week, when Leslie Rcndle sued the United Co-operative Dairy Co. for £250 damages for | alleged negligence. The plaintiff, .who was aged 14, deposed that ho was m the habit of taking his grandfather's' nri'lfr to the factory at Woodville. In April, 1918, he took the milk as usual, and afterwards proceeded to get water osit of a trough in order to wash his cans. There was only one plank across the trough, on which he was - standing, and while in the act of dipping for water with a bucket the board slipped off the top and let him down into the water,' which was boiling hot. He had been in the habit of getting water in this manner on previous occasions. The water was nob always as hot as it was thai morn-' ing. He managed to 6cramble out, but was yery badly scalded about the legs. Ho was still under a doctor, and since the accident had suffered . greai piain. He was claiming £50 for doctor's expenses and £200 damages. • He had visited the factory since he was better, and found that the trough had been removed, and that' water for washing purposes was now obtainable through a tap, thus doing away with the danger of tie trough. No one witnessed tho accident, and the defence was largely a general denial of liability on the grounds that though the company was under contract to take milk when deEvexed at the factory, it was entirely optional whether the plaintiff took tho hot water or not. If he did take it he took it at his own risk and virtually by courtesy of the company. After an hour's retirement tho jury returned with a verdict for the. plaintiff for £50 special damages, lees £25 already paid, and plus £25 general damages. ■ — Early in September it was announced that potash deposits of great value had been discovered north of Maple Greek.
