CLAIM FOR LIQUOR SOLD.
VALIDITY OF AN I 0 U.

WANGANUI, December 2. A point of some importance to hotelkeepers was decided by !Mr W. Kerr, S.M., at the Magistrate' 6 Court this morning in a case in which G. Allen sued Kiel Wilson for £4 13s 6d. The plaintiff was formerly licensee of the Albion Hotel, and tho defendant owed him £2 for money lent and £2 13s 6d for board and liquor. He gave the plaintiff an I 0 U for £4 13s 6d. The defendant paid £2 into court, a,nd claimed as the balance was for liquor it could not be recovered, the law prohibiting such an action,: The Magistrate held that,/as the defendant had given an I 0 U for the amount, that constituted a fresh promise to pay, and it was too late for the defendant to raise the point on which he relied. He accordingly gave judgment for the amount claimed, with costs, less the amount paid into court.
