DEATH SENTENCE UPHELD. APPEAL DISMISSED. Puis Association—By Telegraph—Copyright. SYDNEY, August 28. The appeal of Brown, the murderer of Constable Hickey, against his death, sentence, on the grounds of misdirection of the jury and the wrongful admission of cviclonee,. was dismissed. Thomas Edwin Brown im found guilty on July 30 of having murdered Police-ser-geant Edwin Stuart Hickey at St. Ives, on May 1, and was sentenced to death by Mr Justice Sly. The jury, which, was out for two hours, added a strong recommendation to mercy on tho grounds that, through &o assumed" persecutions under which the aocueed had laboured for a number of yeare, his mind had becomo unbalanced, and, therefore, it was the prayer of the jury that his Honor convey the reoommendation to the proper authorities. His Honor said that ho would do all he could for Brown, but he thought it better to pass 6entenoe on him right away. It was the merciful course to Brown and to his Honor. Tho reoommendation would be passed on to the proper authorities, and Brown would have ample opportunity of saying all that ho felt was iieccssary. Brown's request that he bo a'loH'ed to say good-byo to his six children who were in court before he left the dock, was complied with, and an affecting scene took place. Brown, leaning over the front of the dock, bid an affectionate good-byo to his young sons and daughters, who were weeping piteously. Brown also espreffleo the hope that the ooort would see that ha children were looked after, if his brother-in-law did not undertake to care for them.
