«.—.— CONTINUOUS BREACH. (Pi* United Press Association.) NAPIER, August 30. Mr S. E. M'Carthy, S.M., gave his jesorved judgment to-day in a case of interest to labour unions. A local firm of contractors had employed a driver who was not a member of the union while unionists were available and willing to undertake the work, and were lined some time ago for that breach of the*"-award. They kept the man on. however, 1 and .the Inspector of Awards now brought an action against the firm alleging a further breach. The'magistrate'held that' the 'offenco of not giving preference to a unionist was complete directly the nonunionist'was employed, and'in absence- of any provision in the award malting the offenco a continuous one, and of any breach in the continuity of employment, the offending employers could only be proceeded against for one penalty, not'withstanding the continuance of the noniinionist in "their employment, The case was therefore -dismissed, with costs.
