Cochrane is charged with perjury in connection with the recent suit, Watson Bros. v. the Southland Frozen Meat Company, was concluded tot' day. Cochrane was committed for trial.. The accused David Cochrane, wasoliargod on Monday as follows :-(l) That he did falsely, wickedly, and corruptly commit ful perjury in the testimony which he'gave' on oath as a witness at tho trial of a certain case between Watson/8r03., farmers, of Heddon Bush, and tho Southland Frozen Moat and Export Company (Ltd.), during the sitting of thc-Supromo Court on March 3, 1998, by swearing that "If we have no instructions to tho contrary it is the custom to ship on the first ship without consultation with tho shipper"; and als*» upon the same occasion swearing (a) "It is not our practice when wo have stuff in the works to inquire of customers when it is to go away. It is our practice to ship without communicating with them"; (b) "It is not tho invariable rule to semi out by first ship nniess there are special arrangements"; (d) "Tho Co-operative paid us £500 on the Monday morning, tho'7th of .October. This was not the cheque Cockburn said we. would get": le) "Had oidy ono interview! with Carr by telephone. If Mr Carr says ho rang up next day and I told him I could not find any special in-, struotions to ship it is not correct." (2) That lie. did falsely,, wickedly, and corruptly commit wilful perjury in an. affidavit then and there made by him in, the Court of Appeal by swearing-" That as regards paragraph 3 of the said William Swale's affidavit, the respondent company's practice in regard to stock received from or through J. H. Kirk and Co, been universally adopted by the to ship by the first available steamer without reference to the owner of the meat or the owner's agent unless special arrangeriienlfl are made with tho company as regards holding or otherwise."
