CLAIM AGAINST A GAOL SURGEON.

(Pkk United Press Association.) • WELLINGTON, September 1. The case Brown v. Bears, u claim for £2000, is still before the Supreme Court. Counsel for the defendant opened hie case to-day. Counsel said Drs Martin and Anson thoroughly examined the plaintiff, and came to the conclusion that ho was not suffering from what ho , alleged. It would also bo proved, no matter what they wrote ill the memorandum records, that the doctors told defendant it was not necessary to continue any treatment or attempt to euro what plaintiff was suffering from. Defendant was convinced that plaintiff was mot suffering from his alleged disease, and, backed up by the opinion of two doctors, did then commence to treat plaintiff n.s an ordinary prisoner, and that, it was.submitted, was a perfectly right thing to do. Ho would show in evidence that the treatment which dofendnjiit prescribed and applied wa« the proper treatment to be applied to the ailment from which plaintiff alleged ho was suffering; and also that many statements mad© by plaintiff with regard to his ailment and treatment and tho alleged cause- of his ailment were absolutely untrue. He Would call the warders in charge of the works at Mount Cook to prove that plaintiff did Riot com-, plain of any accident, but only complained of not feeling very well. Plaintiff had in evidence minutely deseribod an accident. Defendant would depose, in accord with this witry, -that cni the morning following it plaintiff did not inform him that he had Buffered an accident as described. All plaintiff complained of was a pain in the back, attributed to lifting bricks. Plaintiff's present statement was not that he strained himself in lifting or that ho suffered pain from heavy work, but that while lifting he slipped and fell. Counsel then called evi- : dence in support of his statement.
