Friday, July 25. (Before Mr E. H. Carew, S.M.) His Worship entered up judgment (or the plaintiffs in tlia following undefended cases: — (Jibbs and Bilson v. Alexander M'Phce (Naseby), claim £7 1U sd, for goods supplied (costs 10s); Grogan's Point Gold Dredging Company (Mr Fiudlay) v. John M. Walker (Wellington), claim 120, calls due (costs £2 6s); Digger's Pride Gold Dredging Company (Mr Brugh) v. James Johnson, ciaim £1 ss, for calls due (costs sb),
Allan Jolm3tone v. the Roslyn Tramway Company.—Claim f-tt Is Gd, for cartage of coal. —Mr Hoy appeared for plaintiff, and Mr W. D. Stewart for defendants.—ln Ill's case the point at is6ue was whether the cartage rate should be 3s Cd or lis per ton.—Defendants admitted the claim up to-the former rale, and paid £33 12s Gd into court.—After hearing lha case, his Worship gave judgment for l'2s over and abovo the amount paid into court, this being for cartage for two days before an implied contract was entered into to cart for 3s Gd per ton. Costs amounting to .£5 Ir, 6d v«.re allowed.—Mr Hay naked leave to appeal, and his Worship pointed out that this was unnecessary, as the amount involved exceeded £20, and it was open to counsel to appeal if he so desired.
