The Legal Committee of the City Council reported to the council on Mr Courtney** motion "that the Bank of New Zealand be now called upon to pay to this council the- amount in 'which such bank is indebted to this council for rent, penalties, eta., in connection with the Auckland' tramways, and that the Legal and Streets Committee be asked to ascertain tha amount due." The committee reported:; "That the penalties accrued are £2103, being £6 per week from January, 1893." The mayor explained that the penalties up to 1893 were remitted by a resolution of the council. Mr Parr moved—"That the matter be referred to the city, solicitors' for their opinion as to whether the council is entitled to recover the penalties." Regarding the period anterior to 1893, they knew the council had agreed to remit tha penalties, but he di~ not know whether any deed embodying the arrangement dm executed. That ought to be sucertained, because, unless there was a proper rekua granted under the seal of the oomifcil, no mere resolution of the council remittinjr penalties would in any way bind fha ratepayers The matter altogether bristkd with legal difficulties. The motion Z unanimously adopted.
