TOTE BUTTING.

(Peb United Pkess Association.)

WELLINGTON, April 20.

Solomon Lewis Was before the court today, and explained that the non-delivevy of notice of appeal was an oversight in his solicitor's- office. No -objection being offered, the case was reheard, to enable him to go on with the appeal. *

Solomon Lewis, who w;is convicted in the Wellington Magistrate's Court on the 30th ult., on-a charge of "tote-betting" and sentenced to two months' imprisonment, but who was released on bail pending an appeal ogainst the decision on points of law. was arrested on Wednesday on a warrant of commitment and lodged in. gaol. It seems that under "The Justices of the Peace Amendment Act, 1885," 11- days is given m which the appeal is to bo Sled, and if it be found on inquiry at the office of the Registrar of the Supreme Court that the papers have not been filed the magistrate can issue a warrant committing any person claiming appeal against a sentence as though no,nppoal had been applied for. It will be remembered (says the Post) that Lewis's ease is the one out of which certain members of the police force have been charged with conspiracy to obtain a conviction. The notion of the police in arresting Lewis caused quite a flutter in bookinaking circles in town.
