A Sporting Case.

(BY TELEGRAPH.) Timaru, May 22. A case much talked about here was settled in the District Court to-day. Jacob Young, a baker, commissioned a well-to-do acquaintance, Richard Allen, to go shares in an investment on a certain horse iix the Dunedin Birthday races in 1890. Allen said he invested on two races and the horse was not placed. He did not invest on the third race, which the horse won. The dividend was L 95. Two years and a half later a man named Collins stated for the first time that Allen did invest on the race. He was halves with him, and received half the dividend. Young, being informed, demanded andsued Allen for the half. The case was adjourned through the illness of Collins, and then Allen went home, and returned for the purpose of defending the case and clearing his character. Several witnesses showed' that Collins' evidence was untrustworthy, and the defendant emphatically denied having any interest in the race. It was shown that probably Collins invented the story i to reduce the effect of a similar charge against himself at the time. The jury found for the defendant, and Judge Ward fully concurred, and said the plaintiff made a mistake in placing any reliance upon the statements of Collins. Collins' evidence was taken previously, f. Hid he was not called for cross-examina-ti ion, as he was suffering from paralysis, with which, by a curious coincidence, he wi is attacked, being then in good health, whule denying to Allen that he had ever saui Alton did invest on the horse.
