Holmes, Sir, —In reply to your letter, dated Dec. 29, I have the honor to inform you that although the Council h»3 n'i power to grant you a;!y legal title to the road or land proposed to be planted, no obstacle will be thrown in your way in carrying out the proposal. —Yours, &c, GEOEGE SUISIPTER, Town Clerk.
Your Committee further find that the occupation 1 y .Mr. Holmes being merely an occupation on sufferance, no rent has been paid or a.aked for the land in question from that gentleman, but that in 1873 the area planted (except the roadline) was included specifically in the Reserve as leased to Messrs. Swansonand
Warburton, with a special covenant on the part of the lessees to enclose the area planted by a fence, which covenant has not yet been carried out. As regards the road-line occupancy, they think that Mr. Holmes should be required to pay a nominal rental of, say, LI per annum, so as to show that at any time the road may be opened up. lie the proposed exchange of Reserve 0 for the N. O. A. and P. Association's Show Ground, your Committee having j considered this question in all its bearings, report the following as in their opinion terms which might be acceded to :
1. The present Show Ground to be conveyed to the Council for ordinary Municipal purposes. 2. Reserve. C io bo vested in joint trust. in the President, of the Association and the Mayor for the time bt-in;;, subject to the provisoes in the paragraphs following : 3. The land not to be alienable. 4. Should no Agricultural Show be held on the ground for the space of five years, the reserve to revert to the Council for the purposes of the original tru.it. 0. The Association to have the right of putting up all buildings, pens, etc., necess.iry for their purposes, but not to let tlte gr"imd, or any part of b, for budding sites, or to erect buildings to lei.. 0. Tiie Association to have the right of excluding the public from their buildings or pens ; and on show days, or when the g"ound is -■•■• quired for the purpose of pveI paring for a show, or for removing exIhi hits, or for the purpose of holding I games or sports, of charging such fee for I admission as the Association think lit.
7. .At ;ill other times than those above referred to the reserve to be open to foot passengers, for whose accommodation not less than three gates or .turnstiles to be erected—one from Wansbcck-street, one from Severn-street, and one from the Town Belt road.
S. Provision to be made for planting or ornamentation being carried out by the trust, at the joint expense of the Corporation and the Association.
0. Any compensation to be paid to the present lessee for the determhiaUou of his lease to be defrayed by the Corporation.
