At the trial the prisoner's counsel demurred to the indictment, stating that he relied upon the judgment given by Mr. Justice Richmond at Nelson in April, 1872, a similar case, holding that under the- Larceny Act, Amendment Act, 1870, a partner could not to be indicted for stealing partnership property; in other words, holding that the Act of 1870 was a dead letter. The Chief Justice held that the first count in the indictment was good ; but that tlio second, third, and fourth counts wero bad. All the other Judges read a written judgment, concurring with that of the' Chief Justice. The demurror raised tothe conviction was thoreforo overruled.
