RESIDENT MAGISTRATE'S COURT.
THIS DAY. (Before G. SrMrreti and S. E. Shiumski, Esqj., J.P.'»). DRUNK AND DISORDERLY. John Ward, charged with having been drunk and disorderly yesterday, was discharged with a caution. ASSAULT. Michael Kenny was charged with having assaulted Ann Evans yesterday. The accused acknowledged the offence, but pleaded that he had received provocation.
The evidence of the plaintiff showed that she had been at the defendant's, and, with his wife, had been having some drink. Some disturbance took place, and the defendant turned the plaintiff out of the house, threw her down, and kicked her.
The defendant called liis wife to prove that, prior to the assault, the plaintifr had made use of abusive language, anil used opprobrious terms towards his wife. Mr. Filluel, Clerk of the Court, deposed that when the plaintiff called at the Court to lay the information, she was smeared with blood,' and bore marks of iil-treatmeuL The accused was fined 405., with the alternative of fourteen days' imprisonment.
