WATERHOUSE AND MBS BARKER. REMARKABLE EVIDENCE. 1 Australian and N.Z Cable Association. LONDON, March 19. In the /Waterhouse case, Mills, Waterhouse’s aged butler, gave evidence that. Mrs Wilson-Barker first visited the Waterhouses 25 years ago. She was then nged about 45. Subsequently, she used to stay there five or six times a year. He detailed instances of misconduct between Frank Waterhouse’ and Mts Wilson-Barker. The misconduct continued over 10 years. • Doctors, gavo evidence that Water house was unable to walk after 1911. He -suffered from an aggravated form of rheumatoid arthritis, and for 18 months before he died had to he carried everywhere. A solicitor, in evidence, said that Waterhouse in 1914 had an income of £2560 under a lue trust, plus a private income of £I3OO. By 1921-22 his private ineotae had gone. BEQUEST OF £4OOO. After hearing argument, Mr Justice Shearman authorised the taking of extracts’from Lady Wilson-Barker’s bank account to show the sums paid in banknotes- in 1921-22. , . .. „ , Frank Waterhouse’s orother, Hugn, fave evidence denying that his. mother ad ever asked her sons to give Mrs Wilson-Barker £BOOO. He identified a tetter by Frank to Lady Wilson-Bar-ker intimating that in the event of his predeceasing iiis mother he wished the Tatter to give I.ady Wilson-Barker £4000;;/Letters passed between themA former male attendant to Drank Waterhouse stated that ho had cashoa large cheques for-Frank,, once in 1914 for £2OOO ih two' notes. Frank asked hifn to take charge of them, and t±en called for the motes on the day Mrs Wilson-Barker called, when the couple were alone in the drawing-room. CONSPIRACY ALLEGED. Airs Muriel Waterhouse, as executrix for her into husnand, whom «he married m 1919, 13 proceeding against Sir David Wilson-Barker, ex-captain ot the Royal: Naval Reserve, his wife, and a man named Shetdpn, all of Hawkhurst, Kent. The statement of claim alleges that Lady Wilson-Barker obtained from Waterhouse large sums by means of fraudulent representation, and that Sheldon and Lady WilsonBarker participated in a fraudulent conspiracy for the same purpose. The plaintiff seeks an account of these payments, and, alternatively, damages.
