CLUB MANAGER SUES. CLAIM FOR OVERTIME FAILS. His Worship Mr W. G. Riddell, S.M., was engaged yesterday in hearing a case in which Frederick White, of Wellington, barman, claimed to recover from the Wellington Working Men’s Club the sum of £SO. The statement of claim alleged that the plaintiff was employed by the club as manager from January, 1921, to September, 1922, and during that time, in addition to the work provided for by the terms of his employment, he worked overtime, being instructed to do so by the executive of the club. It was alleged that the club, in addition, in general meeting had agreed to pay a bonus or gratuity of £25, and later, the first payment not having been made, agreed to pay £SO, and this sum was claimed by virtue of this agreement, or on the ground of equity and good conscience. It appeared from the evidence that the plaintiff had been paid a salary at the rate of £364 a year, and had, in addition, received £49 by way of pay in lieu of holidays, and he received a presentation from nis club members on leaving. Evidence was given that no resolutions as alleged had been passed and that no .claim for overtime had been made by the manager during his services, nor until a considerable time after their termination. His Worship found against the plaintiff, and gave judgment against him on both mounds, with £2 2s solicitor’s fee and £1 16s witnesses’ expenses. Mr W. E. Leicester appeared for the plaintiff, and Mr R. Kennedy for the Wellington Working Alen’s Chib.
