IN POSSESSION OF OPIUM

A CHINAMAN FINED. “SPLITTING THE DIFFERENCE.” A Chinaman named Ah Lyn, residing at 46, Molesworth street) was charged at the Magistrate’s Court yesterday, before Mr F. K- Hunt, STM., with being found in possession of opium in a suitable form for smoking. Mr A. Fair prosecuted, and Mr C. B. O’Donnell appeared for the defendant. Mr Fair explained ' that although only one ' charge had been preferred against the accused, there was evidence or several other offences.

Mr O’Dpnnell said that the defendant. yr as really being prosecuted on his own evidence. lyn had been a witness in a previous “opium case” and had given evidence bn ■ the understanding that • he, himself, would not bo prosecuted. Defendant was liable to a fine of £25, but' counsel asked that under the circumstances he he dealt with as leniently as possible. Mr Fair; This man has been an agent for the passing on of opium; and under the Customs Act is liable to a fine of £SO, and under the Opium' Act may be. fined any sum up to £IOO. The present information is laid under the Opium Act. His Worship: I’ll split the difference Defendant is fined £3O and costs, and has seven days in which to find the money.. -
