SUIT FOR POSSESSION

AN INTERESTING POINT. An interesting point was raised by Mr J. E. Evans, S.M., in a reserved judgment delivered at the Mntpsbrato’a Court yesterday. The case in question wan one where a Women's Aid Society (Mr R. A. Kennedy) proceeded agaonst H. Harris for possession of a house. The plaintiffs were a philanthropic society, and required the house tor its own occupation. Mr O’Donovan raised the point that an incorporated society could not possibly occupy the premies. This, said the magistrate, was a nice point, but he had in this case no need to decode it. The main question was one of hardship, and in that he was satistied that the hardship to the society m not being abie to carry out its laudable objects would be greater than that of the defendant, were he deprived of the right to the premises. Accordingly, he made an order for possession.
