Tinder the advice of their solicitors, Tootal Broadhurst Lee Co., Ltd., at once instituted proceedings iniquity agaiust a number of these firms. Several cases were withdrawn on receipt of an apology and explanation, but Tootal Bro-ad.iiurst I.e-e, Ci*., Ltd., in the interest? of their customers and the public, deemed it. advisable to secure injunctions in certain instances, in order to impress upon tho trade the importance of the matter, and the serious view taken by them regarding the damage which was thus done to their good name and reputation. Li connection with the substitution cases, it is only fair to the retail trade to point ou.t that in certain instances evidence was produced showing that the fabric had been purchased under the impression that it was the genuine guaranteed Tootal product. In other case.? it wa« found that careless shop assistants misrepresented the good 51 without the employers'’ authority or knowledge. Tootal Broadhurst Lee'Co., Ltd., is an old' and reputable British company, which manufactures only the highest ‘class cot- : ton fabrics under its registered trado , marks, which have been extensively advertised in New Zealand and throughout the world, viz., "Tobralco,” largely used . fov ladies' and children's wear, and also ■ a popular shirting material; "Taran-i tulle,” for lingerie and baby wear; j "Lissue” Handkerchiefs for ladle?; 1 'Pyramid” and "Lora” Handkerchiefs foremen; "Tootal” Cloth (a plain and corded velveteen);- "Tootal Pique,” ''Tootal Shirtings” and "Namrit” (a high quality voile in white and coloured designs). Bach of these prod actions is sold # under an absolute guarantee o? quality and service. The injunction? were obtained in order to bring before the public and tho trado generally the fact that the Tootal registered ’trade marks are fully protected. Tootal Broadhurst Lee Co., Ltd., d' ; d not claim damages—they sought solely to protect the buyer and seller of their fabrics, and to establish respect for their' regi<?tertc& brand?. Injunction's only were taken out this time as the firm'did not wish to appear vindictive, but they will bo reluctantly compelled to take more drastic action to protect their goodwill in the event of further substitution. The great demand for "Tarantuße,” "TobraL co/ and other Tootal brands exist? because the women of New Zealand have proved that Tootal fabrics are Unequallea—and know that they are fully guaranteed —and t-hi? confidence on the part of the consumer must be protected. These injunctions show how necessary it is to- every woman not onlv to ask for Tootal products—but to see that she gets them. Every yard of Tootal fabric bear? registered brand on each yard of se,veci!ge. Every garment should bear the sewn-rn label, "Made of Tobralco.” Any reputable dealer will at once give his customer the article asked for—there may ho a few who will endeavour to sell an inferior article carrying a larger P r £fit, but the purchaser must insist on Getting the guaranteed Tootal brand or on. going elsewhere for it. * [Published by Arrangement."]
