SELLING A HOUSE

Jii the absence of a stipulation that an agent shall have the exclusive right to sell, the owner of a house may himself sell. Knowledge .of tho sale acta as a revocation of the agent s authority to sell, Mr McCarthy, came to that conclusion after investigating a claim for commission on tho sale of a house, or in the alternative a similar sum as for services rendered. Defendant sold the house himself, without any assistance from tho agent. The plaintiff alleged that defendant consciously kept the fact of the sale a secret, leaving him to continue fruitless exertions on defendant’s behalf. Mr McCarthy found that tho defendant informed the plaintiff’s salesman that the house had been sold, and that this announcement operated as a revoration of plaintiff’s authority to sell. Judgment was given for the defendant with costa.
