NO SERVICE NO DESERTION
COUNSEL'S PLEA AT COURTMARTIAL. - At the court-martial in the case of Arthur G. McCarthy ~-says a Press Association telegram from Dunedin, it was .summi-ttcd, for the defence, that no court-martial in New Zealand had been heretofore asked to convict a person of desertion in the- absence of a "Gazette" notice, and in addition the nccuscdl did not received a special notice to attend for examination. Counsel submitted that the verdict of the court should be one of acquittal. Tlw weakness of this casei was that accused was merely under an obligation to serve, but as there was no service ho could not dosortThe court reserved its decision.
