Mr Justice Chapman on Saturday delivered judgment in the case of G. B. Walker against the District Hand Registrar. Tho latter was called upon to show cause why he should not register a transfer of land which had been executed by tho Registrar of the Supremo Court, in pursuance of a mortgagee’s sale. Before the sale actually took place The Finance Act, 1918, was passed repealing tho power of a mortgagee to* sell, though the mortgage deed excluded the provisions of tho Mortgages Extension Act, 1914. The Registrar of the Supremo Court, however, was unaware of the new provision, and completed the auction sale and signed a transfer of the land to tho purchaser. This transfer the District Land Registrar refused to register. His Honour held that the Finance Act of 1918 (lid not repeal tho Mortgages Extension Amendment Act, and the Acts Interpretation" Act did not, apply to tho case, so that tho rights of tho mortgagee were not preserved. Tho transfer, therefore, could not ho registered, and the summons against tho District Land Registrar must ho dismissed. Mr Ncavc appeared for tho plaintiff, and Sir John Salmond, K.C., for the defendant.
