ACTION AGAINST T. J. C. GURU informations alleging fraud WITHDRAWN. An unusual case came before Mr W. G. Riddell, S.H., at the Magistrate’s Court yesterday, when. Tasman ■ John Chamberlain Gurr was prosecuted, on informations of fraudulently converting to his own use the sum of jBIOO, part of the proceeds of a promissory note for £lls 18s 7d, which he had in his possession on November 9th, 1911, also that he fraudulently converted to his own use the promissory note fey transferring it to the Union Bonk of Australia. The note was the property of Robert Cooper. Mr C. H. Treadwell, who appeared for Cooper, asked that the informations be withdrawn, as the .£IOO had teen found by some of Gurr’s friends. His Worship would see that the case was one in which not only would there be difficulty in committing the accused for trial but in getting a jury to convict him. Gurr’s counsel, Mr P. H. Putnam, said there never was at any time any intention whatever on the part of his ci’ent to commit fraud against anyone. Cooper, the informant, was the agent of Gnrr in Wanganui, and for the purposes of the agency the promissory note was given by Cooper to Gnrr on the understanding that it would be only used in certain event. The charge of fraud was baseh'on the fact that the note was put into the bank. Counsel submitted that were the evidence called it would not show that there was any fraud at all in placing the note into the hank. Gurr believed that everyone knew it was going in. The whole trouble had occurred through a misunderstanding as to what was to be done with the note. Gurr had since gone bankrupt and had told Cooper that when he was able ho would repay the money. Mr Putnam asked that the information be withdrawn on the ground of misunderstanding.
His Worship considered some evidence should be brought to show that the informations should not have been. laid. Robert Cooper, manufacturers’ agent in Wanganui, sand Gurr had carried on business in Wellington under the name of J. A. Smyth and Co. An arrangement was made with Gurr whereby a promissory note for jEIOO for four months would be given os a guarantee against any. misappropriation of stock or cash, the note to be renewed at maturity and not
