MAGISTRATE’S COURT
FRIDAY, DECEMBER 8. (Before Mr W. Q. Riddell, S.M.) An information laid against David Creech of assaulting Max Wolfo, was dismissed after evidence had been adduced. In connection with this case Creech made application that Wolfo should be bound over to keep the peace on tho ground that Wolfe had threatened to murder, him. His Worship, however, dismissed tho application. Mr P. W. Jackson appeared for Creech, and Mr H. F. O’Leary for Wolfe. John Driscoll was fined 20s and ordered to pay costa amounting to --‘-'1 8s for having used a building in Willis street for a shooting gallery without having first obtained a license. Reserved judgment was delivered by Dr. A. McArthur, S.M., in the case in which the sum. of X 66 13s 2d was claimed by Beatrice Amy Pinnock, carrying on business as tho Arcadia Taxi-cab and Touring-car Service, from John Keir, contractor, Wellington, as damages. The action aroso out of a collision which occurred between ono of plaintiff’s car. and a lorry alleged to have boon owned by Keir, on the Ilutt road on tho evening of October 14th last. Included in tho amount of tho claim was'loss of profit stated to havo been incurred during tho time repairs woro being undergone to tho car. "In my opinion," said his Worship, "the chauffeur of tho motor car was to blame by reason of his negligent driving, and therefore tho plaintiff cannot succeed." . ’ Mr G. Samuel appeared for plaintiff, and Mr P. W. Jackson for defendant.
