SUPREME COURT

CIVIL SESSION. SELLING A MORTGAGED ESTATE. Hearing was resumed before his Honor the Chief Justice (Sir Robert Stout) at the Supremo Court yesterday in the case of Taylor v. Parkinson and Blytli. John Henry Taylor, of Mnlumoa, Obau, farmer, was the plaintiff, and Walter Pox Parkinson and Harry Alexander Poster Blytli, of Ataahna, Canterbury, farmers, were the defendants. Plaintiff sought to obtain accounts of the sale, at defendants’ request, of his mortgaged property; and ho further claimed a balance which he alleged was payable over and above the amount due to defendants under the mortgage. Mr Martin Chapman, K.C., with him Mr G. 11. Fell, appeared for plaintiff, and Mr T. W. Stringer, K.C., of Christchurch, with him Mr M. S. Brown, fertile defendants. Further evidence on behalf of defendants was given by G. Gilsby, Joseph d’Ath, farmers; W. F. Parkinson, one of the defendants; and M. S. Brown, solicitor to defendants. After counsel had addressed the Court, Iris Honor intimated that he would reserve his decision. AN INSURANCE PROBLEM. WAS THERE COVER? Legal argument in the case of David O'Hara v. the Victoria Insurance Co., Ltd., was heard by tho Chief Justice yesterday afternoon. Plaintiff claimed to recover .£7OO, insurance money alleged to bo duo on two houses whidh were destroyed by fire in January. It was claimed that the Victoria Insurance Co. took over from the Queensland Co. a number of insurances for which Easson Bros, were tho subagents. Included were tho two houses under notice. Defendant company contended that those houses had never been covered by them. Mr B. J. Pitzgibbon appeared for the ’plaintiff, and Mr T. Young for the defendant. The learned judge reserved his decision.
