THE CASE OF O. E. HARDEN. PRESS ASSOCIATION. PALMEEBTON NOETH, Ssptembr 13. At tho Supremo Court on Saturday, 0. E. Hanlon, solicitor, was charged before Justice Clbapman with fraudulently failing to account for or pay trust moneys to tjie amount of £250, and thereby committing theft. Mr Louebnan, Crown Prosecutor, appeared for the Grown, and Mr V/ilford appeared for accused. Tile evidence for the prosecution was tho same as given in the lower Court. For the defence. Era O'Brien. Wilson and Martin gave evidence that accused had been suffering from tho effects of excessive alcohol for months prior to his arrest, and Wto incapable of conducting his business intelligently. . His Honor, in summing up, said tho point the jury hod to consider was whether accused was in a capable mental condition and had committed a wilfully dishonest act. Tho jury were absent for two hours, returning a verdict of not gniity at midnight.
