AN APPEAL CASE.
DREDGTTMASTERS* RESPONSIBILITY. PBESS ASSOCIATION. DUNEDIN, June 2. District Judge Ward gave his decision to-day in an appeal case affecting dredgemasters. John Tough, of Miller's Flat, had been charged with a breach of the mining regulations by permitting the moving of the lines of a dredgo without the crew of the boat engaged wearing lifebelts. Tough was present when the men wore engaged, and did not order them to wear bolts, or protest against therm not doing so. An accident occurred, and a young man was drowned. Warden Bnrpess held that Tough’s duty ceased when life-saving appliances were there, and the responsibility for not wearing the belts lay with the crew. This was the decision appealed against. Judge Ward allowed the appeal. holding that it was Tough’s duty to see the men wore lifebelts. If he allowed them to proceed without protest, be became an accessory. The case was remitted hack to the warden, with instructions to convict, disbursements to bo payable by respondent.
