A PICTURESQUE ATLAS CASE.

PRESS ASSOCIATION. Invercargill, October 16. Bowerman Bros, are proceeding against subscribers to the Picturesque Atlas with varying success. D. StraDge, a well-known coffee merchant, resisted payment because tho books were not deliverer?, and succeeded, the plaintiff being cast §in costs. It appeared that the books wore left in the entrance to Strange’s office by Bowerman, and disappeared. To-day the firm sued John Scott. Ha declared that he never signed any order for the book; that when the canvasser Metcalfe, showed him pictures of Australia, he said he had no interest in other colonies, though he might take a similar work on Now Zealand if published. That, Metcalfe stated, was his own feeling, and he was tryiDg to get support for such a work. He naked Scott to sign tUe_ list of patrons,

which he did. Soott declared that the list produced was not the same, and described the differences. He also affirmed that he never sigued any order. A bank official deposed that to the best of his belief the signatures were all Scott’s. Mr Rawson, R.M., gave judgment tor the defendant on the ground that ha had beon fraudulently induced to sign an order for a Pioturesque Atlas of Australia, at the time belioving he was signing a patron’s list for similar works referring to New Zealand, and that the canvasser represented that Scott would have an opportunity to inspeot the work before subscribing for it. Leave to appeal was refused on tbo ground that th 9 decision was on a matter of fact. Metcalfe was not produced.
