IMPORTANT DECISION.

(united press association.) Dunedin, October 27. Mr Justice Williams gave an important decision under the Distress Act to-day. A sewing machine hired in the usual way was distrained for rent by a landlord, and the Magistrate held that section 5 of this Act made articles hired without the consent pf the landlord distrainable. Mr Justice Williams held that section 3 reversed the former principle, and that landlords had a lien only in respect of goods of a particular person, found on his premises. He confessed he could not ascertain why the section 5 was introduced into the Act, and he thought it should be regarded as surplussage. He therefore reversed the decision of the Magistrate.
