HAMILTON, Monday An unusual case was heard before Mr. Justice Johnston in the Hamilton Supreme Court to-day, when Charles Sutherland St. Clair and Alma Jane. St. Clair proceeded against Herbert John Warrington, asking for the removal of defendant's house on the grounds that it encroached on their property. Defendant denied this .and said that he had offered to buy any land on ■which it was proved the house encroached. Defendant counter-claimed for £'2s for the alleged wrongful cutting of a hedge which divided the properties. It was stated that defendant's house encroached to the extent of 2ft. 9in. His Honor made an order that defendant was entitled to retain the piece of land on payment of £lO. The counter-claim was dismissed, no costs being allowed.
