PRIVY COUNCIL APPEAL REFUSAL OF APPLICATION £bt telegraph OWN correspondent] WELLINGTON, Friday An application by Dr. Kennick Holt Dean, Palmerston North, for leave to appeal to the Privy Council has been refused by the Court of Appeal. The history of the case is as follows: —A jury awarded Mrs. Olive Rita Paterson, Palmerston North, £572 damages against Dr. Dean for negligent treatment of an injured leg. Mr. Justice Quilliam granted Dr. Dean a new trial on the grounds that the verdict was against the weight of evidence and that the damages were excessive. The Court of Appeal allowed an appeal by Mrs. Paterson against the order for a new trial and affirmed the verdict of the jury. Dr. Dean then applied for leave to appeal to the I. nvy The Court'in its judgment held that the amount required to entitle a litigant to leave to appeal as of right was £SOO sterling and not £ooo iNew Zealand currency. In this ™; se the amount of the judgment sought to be appealed from was £572 6s New Zealand currency, which was less than xouu sterling. , . . . The Court was also of opinion that the questions decided in the case were not of such great general or public importance that special leave to appeal should be given to Dr. Dean.
