MISREPRESENTATION DENIED SUPREMF. COURT HEARING Tho hearing was continued in the Supreme Court yesterday of the case brought by an Auckland sawmiller, Stanley Vivian Watson, against a Piha farmer, James William Ingley, for £14.39 14s 7d for alleged misrepresentation. Mr. Justice Callan presided. The case began on Tuesday, continued throughout yesterday, and was unfinished last evening. Mr. Reed appeared for plaintiff and Mr. Matthews for defendant. . Plaintiff alleges that because of defendant's misrepresentations, he moved his sawmilling plant to a block of bush country, entered into a contract with defendant, and borrowed certain moneys to effect the removal of the Jlant and provide preliminary capital, t was contended that the true owners of some land sold it, and plaintiff was prevented from performing his contract. The defence is a denial of any contract. It is also submitted that plaintiff never achieved a dav's output of .3000 superficial feet, and that defendant continuously delivered to plaintiffs mill a larger supply of logs than Slaintiff was able to cut. Nothing was no to either party on the contract, which, if it did exist, was discharged by mutunl consent. The case will be continued this morning.
