ASSAULT ALLEGED

EPISODE OUTSIDE HOUSE ACCUSED PLEADS NOT GUILTY Pleading not guilty, Harold Victor Davies appeared before Mr. Wyvern Wilson, S.aj:., in the Police Court yesterday, charged that, with intent to do grievous bodily harm, he did actual bodily harm to Newton Hedley Fairs on April 11. Detective-Sergeant Walsh prosecuted and Mr. Sullivan appeared for accused. Ty, Edmondson, of the Auckland Hospital, said that Fairs was admitted to hospital about 9.60 p.m. on April 11. On he was found to be suffering from a"* dislocation of the fourth cervicle vertebra. It could have been c&used by a blow on the neck or a twist. Fairs also had a bruised lip and a broken denture, two or three of the teeth , being missing. His present condi tiotf~was very satisfactory. Evidence was given by Fairs that at 6.30 p.m. on April ll he went to see a friend. On nearing the friend's houso he saw accused, who called witness back as he reached the verandah. Davies said, "What is this you are saying about my girl Elsie ? What do you mean by trying to turn her against me?"

Witness said that he replied he was a friend of the family and somebody had to do something about the wajDavies was knocking the girl about. Witness then asked accused what he was going to do about it, and Davies replied, "Just this," and struck him. "He hit me on the side of the face," added witness. "I went to duck, but slipped and caught hold of Davies' legs. I was nearly on my knees when he struck me on the neck. Girls rusher! out from tho house and I was picked up." Witness then went home, he said, and as his neck became very sore lie went to a chemist and on his advice went to the hospital. ( Mr. Sullivan was about to crossexamine tho witness when the magistrate adjourned the case until Friday.
