It was stated that the defendant transported his pumpkins, which ho claimed were perishable goods, to Wellington, leaving part of the load nt Palmerston North. The police contended that pumpkins were not perishable. Counsel for the defendant said that the latter lost over a thousand %acks of pumpkins last year through not getting to market in time. Ho contended that cartage on Sunday was a , necessity. Defendant therefore was exempted under the Act. The Magistrate held that the fact that a special train was provided at Hastings on Sundays for the carriage of produce made it unnecessary to tako it by road. Defendant was fined £2.
