APPEAL DISALLOWED MINISTER'S DECISION CAMBRIDGE-AUCKLAND RUN In giving a reserved judgment in connection with an appeal by I). G. Kelly, of Cambridge, against a decision of the No. 1 Transport Authority, Mr. K. J. Phelan, regarding a passenger motor servico between Cambridge and Auckland, the Minister of Transport, the Hon. P. Semple, said that from a study of the Hamilton-Auckland road and rail services he was satisfied that the present facilities were fully adequate. An additional service was not warranted and its authorisation would have an adverse effect on the services already in existence. When- an application was made by appellant a decision was given by Mr. Phelan on October 14, which prohibited the picking up and setting down ol passengers between Tamahere and Auckland. The following day a decision was made amending the time-table of Markev's Motors on the HamiltonAuckland route. 'An automatic licenco for one trip daily, except on Sundays, between Cambridge and Auckland, was granted to Kelly in March, 10.32, subject to restrictions regarding the picking up and setting down of passengers between Cambridge and Hamilton and Papakura and Auckland. Renewal was refused both on the original application and appenl in 193:}, and a fresh application was lodged, the main point in support being that the service enabled Cambridge residents to make a one-dav return trip to Auckland on six days j of the week. The Railways Board opposed the application on the ground that rail and road services were adequate. Amendments to permit the use of an eigbt-seater vehicle and the (reduction of fares on intermediate sections ; were requested when Kelly appealed j for renewal of the licence in May. IVM.>. j The application was granted, the first j amendment being allowed and the | second refused. In the present application, Kelly sought the right to use a vehicle seating 1G persons. Opposition to this proposal was voiced by the Pailways Department, while Marker's Motors, , operating between Hamilton and Auckland, objected to appellant picking up passengers between these terminals. Permission was granted for the use of the larger vehicle, but it was stipulated that passengers should not be picked up or set down between Tamahere and Auckland. Kell.v appealed against these restrictions. The appeal was disallowed on the grounds stated above and the further appeal against the granting of an alteration in the time-table from Hamilton to Auckland to Markov's Motors also was disallowed, it being held that was dependent for success on the main appeal, which had not succeeded.
