GISBORNE CONTROVERSY
- FIRE BOARD'S PROPOSALS OPPOSITION TO RAISING LOAN [BY TELEGRAPH OWN CORRESPONDENT] GISBORNE. Friday Following the recent controversy between the Gisborne Borough Council and the Gisborne Fire Board, regarding the board's proposals to raise a loan of £II,OOO for the purpose of erecting firemen s dwellings and reconstructing and enlarging the board's present buildings, Supreme Court proceedings have been initiated with the object of restraining the board from proceeding with its plans. It is alleged that the action of the Fire Board and of the Local Government Loans Board in sanctioning the proposals is ultra vires under the respective Acts governing their operation, and the Court fs asked to grant a writ of certiorari setting aside the decisions of both bodies, a writ of prohibition restraining them from proceeding further under their decisions, and a writ of injunction restraining the Fire Board from raising money in pursuance of loan proposals. Plaintiff in the action is Henry Victor Lunken, retired storekeeper, of Gisborne, and defendants are the Gisborne Fire Board, members of tho Local Government Loans Board individually, and the Attorney-General of New Zealand.
